My son moved into my house while I am in the ALC and waiting to go to the nursing home. He came from the Retreat (BOL) and brought one-half of my terrible duo with him...Duchess, a female Tibetan Mastiff that goes about 125 lbs. Well, seems like a couple thieves decided to investigate the shed in the back yard, and managed to scale the 8' cyclone fence to check it out. Guess they didn't notice the "Beware of Dog" and "Dog WILL bite!," signs. Son nailed one, the other got away. Son called 911 and they showed up with an ambulance, fire truck and the County Sheriff's deputies. Meanwhile, Duchess was chewing on the guy's arm. They took him to the hospital, no telling how many stitches he'll need. Too bad the only thing they can charge him with is criminal trespassing.
 
She's trained to "hold," but if they keep trying to get away, she bites, and keeps on biting.

Good doggy, my Malinois is the same way. The more one wiggles, it triggers that crazy prey drive they have, lol.

Yeah, but now she's on a two week "quarantine-in-place" ordered by Animal Control and the Health Department. In two weeks she's got to go to the Vet for a "rabies clearance," which has to be faxed b y the Vet to Animal Control, the Health Department and the County Sheriff's Department. $45 for the "Clearance." Idiot ignores the signs, comes over the fence, gets chewed up for his trouble, and my son has to pay $45 for a rabies clearance! How come the thief isn't the one paying?? Sucks~!~!

When he gets sentenced ask the court to order him to pay reparations. When he gets out of jail he'll have to pay. You can ask for help from his probation officer or you can get a Writ of Execution or a Garnishment. You add any costs plus interest. The technical term is 'adding insult to injury'.

Pretty much standard procedure. Is it right, not in my mind.

Let's just hope the perp doesn't sue for damages. There was an incident a few years back where a guy actually broke into a home, got bit and sued the homeowner..................and won.
 
If you have "beware of dog" signs up, you obviously knew your dog was dangerous. Dangerous animals must be kept in enclosures not just a fenced yard.
OK, any dog or cat can be dangerous under the right circumstances. It is still better not to have the signs up.

The dog is TRAINED...not dangerous unless you are popping over the fence after dark!

Ala. Code, Title 3, Section 3-1-5: (a) Every person owning or having in charge any dog or dogs shall at all times confine such dog or dogs to the limits of his own premises or the premises on which such dog or dogs is or are regularly kept.  Nothing in this section shall prevent the owner of any dog or dogs or other person or persons having such dog or dogs in his or their charge from allowing such dog or dogs to accompany such owner or other person or persons elsewhere than on the premises on which such dog or dogs is or are regularly kept.  Any person violating this section shall be guilty of a misdemeanor and shall be fined not less than $2.00 nor more than $50.00.

Alabama Leash Law
Dogs are not permitted to run at large in Alabama. They must be appropriately confined at all times, either by a leash when off the property or other means to keep them within an owner's property. A dog owner may be fined between $2 and $50 for failure to leash the dog.

That is the standard for Alabama. Then you get other ordinances for just some counties and even more if within the limits of certain cities. You are within state law which most counties and cities follow. Its a hodgepodge in parts of this state...

Around the country, forget it... not telling what lefty loons will come up with in other states.

As a former citizen of the Great State of Alabama, I can tell you this is no different than if you crawl thru some guy's fence and his bull polishes the surface of planet Earth with you.
Happens all the time.
People in the courtroom will say:
"Well that was stupid! He's lucky to be alive:rolleyes:".

There are no 'protection of idiots' laws. If you had a fence, and they went thru it...see above.

(and don't ask me how I know how much being used as a polishing-cloth for planet Earth hurts:eek:)
But I can tell you, it hurts a LOT!
