I have seen that happen before. It's supposedly about liability.

If you drive into a pot hole the city hasn't fixed, it's almost an act of God. If you drive into a privately filled pot hole, both the pot hole filler and the city is liable because they allowed unauthorized repairs.

It doesn't make any sense but that never stopped anyone from winning stupid prizes..
